2 APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale define the conditions of sale between Mookah and any individual (hereinafter the "Customer") making a purchase on the Site. They apply to all orders for non-corrective optical products (sunglasses, blue light glasses, accessories). Confirmation of the order implies unreserved acceptance of these General Terms and Conditions of Sale.

3 ORDER AND PRICE

The Customer selects their Products on the Website. A detailed summary (price, delivery fees) is available before final validation.

  • Price: Prices are indicated in Euros (€). For specific markets, the price may be displayed in the local currency (Swiss Franc CHF, Canadian Dollar CAD, American Dollar USD, Singapore Dollar SGD) according to the current exchange rate. In accordance with article 293 B of the French General Tax Code, VAT is not applicable (VAT exemption).
  • Payment: Payment is due immediately on the day of the order. We accept a wide range of secure payment methods to facilitate your purchases:
    • Installment Payments: Klarna (pay later or in several monthly installments).
    • Mobile & Fast Payments: Apple Pay.
    • Local Options: Bancontact (Belgium), EPS (Austria).
    • Credit Cards: Visa, Mastercard, and American Express.
  • Security and Fraud: Your banking information is never stored on our servers; it is processed by our certified payment providers. Mookah reserves the right to cancel any order in the event of a payment incident or suspected fraud.

4 AVAILABILITY AND DELIVERY

  • Availability: Should a product be unavailable after an order is placed, the Customer will be informed and can choose another model or a refund.
  • Delivery and shipping: Products are delivered free of charge to the address indicated by the customer when placing their order. Mookah accepts no responsibility for any address entry errors. All orders are prepared and shipped within 24 to 72 hours (business days). For the United States: 5 to 12 business days; for Europe and France: 7 to 15 business days (France, Belgium, Spain, Italy, Germany, Luxembourg, Netherlands, Portugal, and Austria); for Canada and Switzerland: 7 to 15 business days; for Asia: 10 to 15 business days (Singapore and Malaysia).
  • Customs fees: European Union and United States: No additional taxes are foreseen upon delivery. Switzerland, Canada, and Asia: Customs duties or import taxes may be applied by the local carrier. These fees are the responsibility of the customer.
  • Delivery incident: For any order not received but indicated as "delivered" by the carrier, a sworn statement or a complaint may be requested to proceed with a reshipment.

The transfer of ownership and risk of loss or damage occurs when the Customer (or a third party designated by them) takes physical possession of the product.

5 RIGHT OF WITHDRAWAL (14 DAYS)

In accordance with article L221-18 of the Consumer Code, the Customer has a period of fourteen (14) calendar days after receipt to exercise their right of withdrawal.

  • Conditions: Glasses must be returned in their original packaging (case, plastic protection, box), in perfect condition, unworn, and accompanied by all accessories. Any product that is incomplete or damaged by the customer will not be eligible for a full refund.
  • Procedure: The Customer must contact support at contact@mookah.fr or make a request via their customer account to obtain the address of the specific pickup point.
  • Shipping: Return shipping costs are the sole responsibility of the Customer. Returns must be made via Mondial Relay to the pickup point designated by Mookah. The customer must create and pay for their label on the Mondial Relay website.
  • Refund: It is processed within 14 days after receipt and inspection of the product. The refund only covers the price of the returned products; initial delivery costs are not refunded.
  • Defective product: In case of damage upon receipt, the customer has 48 hours to report it with video proof. Mookah reserves the right to refuse a refund if the defect results from deliberate damage or misuse.

6 LEGAL GUARANTEES

Mookah is liable for non-conformity defects (Art. L. 217-3 of the French Consumer Code) and hidden defects (Art. 1641 of the French Civil Code).

The warranty exclusively covers proven manufacturing defects (frame defects or faulty lens treatment upon receipt).

The following are strictly excluded from the warranty:

  • Accidental breakage and damage resulting from a fall.
  • Scratches on lenses (considered to be the result of improper care or daily use).
  • Deformation of the frame due to forced handling (wearing on the head, removal with one hand).
  • Alterations due to exposure to extreme heat (behind a windshield) or contact with chemical products (perfumes, solvents).
  • Normal wear and tear of materials and screws over time.

7 DATA PROTECTION

Mookah collects data (Name, address, email) solely for order processing and customer relationship management. This data is never sold to third parties. For more details, please refer to our "Data Protection" page.

In accordance with Article L.223-2 of the Consumer Code, the customer is informed of their right to register on the Bloctel cold calling opt-out list on the website www.bloctel.gouv.fr.

8 RESPONSIBILITY AND SAFETY

Mookah sells products that comply with current European standards (NF EN ISO 12312-1) and with Regulation (EU) 2016/425 on personal protective equipment. The lenses are certified UV400 and Category 3 (high protection against solar glare). These glasses comply with CE standards.

An information and safety notice is available online on our website and sent electronically. Mookah cannot be held liable for damage resulting from improper use (e.g. direct observation of the sun, night driving, or protection against artificial light sources).

9 MEDIATION AND DISPUTES

In the event of a dispute, the Customer undertakes to first contact customer service at contact@mookah.fr. If no solution is found, the Customer may free of charge refer the matter to the consumer mediator CM2C or use the European Commission's online dispute resolution platform. These General Terms and Conditions are governed by French law.
